1. Trading Terms Strictly nett 30 days.
2. If Terms of Trading are not adhered to, despatch of any orders could be delayed.
3. Goods will be charged at the ruling price on the date of despatch.
4. Prices and Products are subject to alteration without notice.
5. List prices do not include goods and services tax (GST) and, where applicable, this will be charged as a separate item on the invoice.
6. Unless otherwise specified, all goods despatched per rail or customer’s carrier are at customer’s risk. Freight costs beyond rail or transport terminal are customer’s responsibility. No responsibility will be accepted for breakage, damage or loss in transit.
7. All orders with an invoice value of $300.00 or LESS will be subject to a packing and/ or delivery fee. This surcharge will not apply to backorders if the original order value exceeds this limit.
8. Standard goods will not be accepted for return unless with our prior agreement. 30 Day Limitation. Original invoice numbers must be quoted. NEFA Australia will not accept liability for Freight charges on returns other than for our nominated carrier. Goods and packaging must be in original condition, free from damage and blemishes. All goods returned will be subject to a handling surcharge. Goods Made To Order or not listed in our standard price list are not returnable.
9. Orders cannot be cancelled except with our consent and upon terms that will indemnify us against all losses. Goods or materials ordered in error or in excess cannot be returned to us for credit or exchange without first obtaining an authorisation number from our office, and will be subject to clause 8 above. Orders or balances of orders may be cancelled at our option in the event of failure by the buyer to adhere to the terms of the contract.
10. I/We agree to notify NEFA Australia in writing of any change to the legal status of the account trading name.
11. "The risk in the goods shall pass to the buyer on delivery but the legal and equitable property in the goods shall not pass to the buyer until payment for the goods and all other goods supplied by the seller to the buyer has been received by the seller. The buyer may sell or deal in the ordinary course of business with the goods and with the interest of the seller in the goods and may for the purpose of such sale or dealing part with possession thereof but the proceeds of any sale or dealing will be held by the buyer on trust for the seller and shall be paid into a separate account and appropriated in paying all sums owing to the seller. The buyer hereby agrees to accept this appointment as trustee. Subject as aforesaid the buyer shall, so long as the seller is entitled to the property and the goods, store the same so that they are clearly identifiable as the property of the seller." :Without prejudice to any other of the seller’s rights, the seller and the buyer agree that the seller may enter upon the property of the buyer to recover the goods which remain the property of the seller hereunder in the event of default, within business hours without notice, and take possession of those goods.
12. All goods shall be deemed to have been inspected by the buyer as being in accordance with the contract unless notification to the contrary is received in writing by NEFA Australia within 7 days from the date of invoice provided that claims for short deliveries must be made within two (2) days from receipt of goods. Goods accepted as faulty will be credited at invoice value or replaced at NEFA Australia’s option. No responsibility will be accepted for the cost of any repairs or alterations executed without the prior consent of NEFA Australia in writing. The use of incompatible or other brands of products in conjunction with our products may render our guarantee void. No claim will be recognised unless invoice and/or delivery docket number is quoted. The above governs the relationship between NEFA Australia and the buyer, but is without prejudice to the rights of the buyer under the Trade Practices Act 1974 in respect of claims made by consumers against buyers.
13. Unless specifically agreed in writing, under no circumstances do we undertake liability for any loss or damage to persons or property of any nature or due to any cause or any amount as a result, direct or indirect, of any defect, deficiency or discrepancy in goods or material sold or supplied by us. In this respect, all conditions, warranties and liabilities, expressed or implied, statutory or otherwise not contained herein, are expressly negated. It is the buyer’s sole responsibility to ensure that the goods are sufficient and suitable for his/her purpose.
14. NEFA Australia provide fully trained service staff to ensure satisfaction. Where it eventuates that the problem to be serviced by our staff arises from an initial faulty installation or incompatible or faulty goods of another brand, a service charge of $50.00 per hour, including travelling time, with a minimum fee of $50.00 will apply. Proof of purchase may be required before work commences. Acceptance of goods is acceptance of above terms. No other conditions as implied by customer’s order, etc. will be considered unless accepted in writing by the Management.
FREIGHT CHARGE A freight charge will apply to all originally invoiced orders of less than $300.00 nett value
PROOF OF DELIVERY Where Proof Of Delivery is obtained and delivered, a $15.00 charge will be applied.
CREDIT RETURNS Goods will not be accepted for return without our prior agreement. A handling surcharge may be applied.
